Press Release – New York, NY – April 29, 2026 – Sichenzia Ross Ference Carmel LLP prevailed before the U.S. Court of Appeals for the Second Circuit in affirming the dismissal of a lawsuit brought in the Southern District of New York against its client Drgut Pelinkovic, in which the plaintiff attempted to enforce an oral partnership under New York law in connection with an investment in cryptocurrency assets. All causes of action were dismissed as a matter of law under New York Partnership law and common law. The Second Circuit affirmed the District Court’s decision in its entirety, resulting in dismissal of the complaint with prejudice as the court found any further amendment of the complaint would be futile.
